The Wyoming Division of Criminal Investigation says that using, selling, and possessing cannabis is illegal. As of 2020, Wyoming has not legalized recreational or medical marijuana, and it is against the law to use or possess weed (THC) in the state. While cannabis is not legal, hemp-derived cannabidiol (CBD) products that contain less than 0.3% THC by weight are legal to use and possess. In Wyoming, the penalties for marijuana are among the harshest in the United States. According to state law, individuals knowingly or intentionally using cannabis can be charged with a misdemeanor, including 6 months of jail and a $750 fine. For possession of small amounts of marijuana (less than 3oz or 85 grams) defendants can be charged with a misdemeanor and 12 months of prison with a maximum fine of $1,000. If defendants are charged with more than 3oz (85 grams), they face a felony, up to 5 years of prison and a $10,000 fine.

Since 2015, a strict process through the Wyoming Department of Health (WDH) allowed medical CBD to be prescribed after application and approval for a Hemp Extract Registration Card, costing $150 annually. The law permits people the use of medical CBD oil products containing less than 0.3% THC by weight. Intractable epilepsy was the only condition Wyoming permits patients to use CBD oil to treat. As of March 6, 2019, the state enacted HB0171 –  making the Department of Agriculture the authority for hemp regulation and production. The act formally removed hemp, cannabidiol from the Wyoming Controlled Substances Act.
